Dear Customer, before accessing our price list, please read the general terms and conditions published hereunder that are applicable to the sale of our products.
General contract conditions
1- Under art. 1522 of the italian civil code, the products manufactured by Petra Antiqua s.r.l. are sold on the basis of sample types: samples are supplied purely to give a general and approximate indication of the characteristics of the products manufactured by Petra Antiqua. In particular, the nominal dimensions of the product types and the thickness, if and where indicated, lie within the standard tolerances for the sector. Natural stones might have considerable differences in colour and/or tumbling between the goods delivered, the reference samples and photographs from our catalogues.
2- Unless otherwise established in writing, prices are ex-works. Packaging is always invoiced. Customers must specify any special packing requirements when ordering. For ex-works or carriage forward delivery, goods will be despatched by carrier and will travel at the risk and peril of the purchaser. Goods are considered as delivered when they are handed over to the carrier and, unless otherwise agreed, transport expenses will be charged to the purchaser; even if the price includes transport costs, transport is always carried out on behalf of the purchaser and therefore at its own risk. The customer must check the goods on arrival. For ex-works deliveries by B.G. Logistik srls - via Statale, 467/a - S. Antonino di Casalgrande (RE), the price includes storage costs, with the obligation of the purchaser to collect the goods within 15 days of arrival at the warehouse: if the goods are not collected within this deadline, costs for additional custody and warehousing will be exclusively charged to the purchaser. Delivery terms are not binding and are purely indicative.
3- Unless otherwise agreed, prices refer to the product sold in complete boxes. The contents of the boxes are also described in the general technical information (weights and measures table).
4- Orders must be made in writing: in order to improve its service, Petra Antiqua s.r.l. advises its customers to send their orders by fax or e-mail, clearly showing all the necessary details. Petra Antiqua s.r.l. reserves the right to accept orders by sending its fax or email confirmation: order cancellations or modifications will not be accepted after 3 days from the confirmation date. When preparing and invoicing orders, exclusive reference will be made to the prices, measures, quantities, thicknesses and finishes indicated in the order confirmation: the purchaser should therefore check the accuracy of the information in this document.
5- Petra Antiqua s.r.l. products are made from natural stone: any colour (or generic) inconsistency are innate to the products and cannot therefore stand as grounds for claims. Differences in colour and/or tumbling between the sample and the delivered goods, even if considerable, cannot stand as grounds for claims. Any claims for faults and/or defects must be sent by registered post within 8 days of receipt of the goods: Petra Antiqua s.r.l. will collect and replace faulty and/or defective goods; in no case may faults and/or defects stand as grounds for cancellation of contract and/or price reduction and/or claims for damage compensation. Claims or disputes for material already installed can not be accepted (after discovering the fault and/or defect, the purchaser must immediately stop processing and/or using the goods). Under art. 1490, paragraph 2, of the italian civil code, “second-choice” and “commercial choice” materials are not covered by any warranty. In the event of disputes or claims by other purchasers, save the standard warranty, all right of redress against Petra Antiqua s.r.l. is excluded, pursuant to and for the effects of art. 131 of the consumer code (legislative decree 206/05). Payments must be made according to the terms and conditions indicated in the order confirmation. In the event of late payment, legal interest rates and credit collection costs will be charged.
6- All disputes (concerning contractual and non-contractual relations between Petra Antiqua s.r.l. and its customers) will be exclusively submitted to the court of Vicenza.
7- These conditions also apply to foreign customers: to all effects and purposes of law, the contractual relations between Petra Antiqua s.r.l. and its customers are governed by italian law and in the italian language; legal issues deriving from these relations will only be heard by italian judges.
8- These general contract conditions cancel and replace the conditions indicated in the previous editions of the Petra Antiqua s.r.l. price-list.

General technical information and product characteristics
Our products are hand-made. The dimensions and thicknesses indicated in the price-list are purely nominal due to the fact that the sides are rounded during the tumbling process. More or less accentuated colour differences compared with the settings shown in the catalogues should be considered as innate characteristics of natural marble. The colours and shadings of the materials illustrated in the catalogue are not binding. Samples are purely general and approximate indications of the product characteristics. Delivered goods may have considerable differences in colour and/or tumbling compared with the samples and photographs from our catalogues. All samples supplied by Petra Antiqua are purely indicative and non-binding, also as concerns colours. Given the characteristics of natural stone, Petra Antiqua can never guarantee that the colour of different formats of the same type of marble will be the same; colours may not be uniform even if the formats are requested on the same order. Petra Antiqua cannot guarantee that the colour of completion orders will be the same as the previously delivered as the colours of natural stone can not be classified. All sizes are expressed in centimetres. Though we take most care and attention in choosing raw materials and observe extremely accurate processing parameters, the customer must check the quality of the delivered material before installing it. During installation, moreover, the tiles should be taken alternately from different boxes. In no case Petra Antiqua s.r.l. will accept claims for material that has already been installed. This price-list cancels and replaces all previous versions: Petra Antiqua s.r.l. reserves the right to modify the information in order to improve the characteristics of its products.

We hereby declare that we have read and duly accept the general terms and conditions of Petra Antiqua Srl and specifically approve the following terms and conditions: articles 1 and 5: dimensions within tolerances of use; differences with respect to samples and photos of the catalogue - possible differences of colour; - article 2: non-mandatory nature of the delivery terms; - article 4: deadline for cancellation or modification of an order; order confirmation document and obligation to check the document; article 5: terms for filing claims; limitations of liability and exclusion of the obligation of recourse for Petra Antiqua S.r.l.; - article 6: exclusive jurisdiction; article 7: applicable law, language and applicable jurisdictions.
